Notice of Remedy for Delays Due to Japan Earthquakes

May 11, 2016, SIPO issued a notice of remedy for delays to those patent applicants, patentees and others who suffered the influence of Japan earthquakes at the city of Kumamoto on April 14, 2016 and afterward, which is shown as follows:

 

1.    If the time limit prescribed in the Patent Law or its Implementing Regulations, or specified by the Patent Office was missed due to the earthquakes or the caused secondary disasters, which thus results in the loss of corresponding rights, it shall apply to the provisions of Rule 6, Paragraph 1 of the Implementing Regulations. The party concerned may, within 2 months as of the removal of the impediment, or at the latest within 2 years as of the expiry of that time limit, request the administrative department for patent under the State Council to recover his/her/its rights by stating the reasons and affixing relevant supporting documents.

 

2.    Where a party concerned is not able to fulfill some procedures within the time limit due to the said disasters, it shall apply to the provisions of Rule 6, Paragraph 1 of the Implementing Regulations. He/her/it may requests extension of the time limit before the expiry of the said time limit by stating the reason and fulfilling relevant formalities. The time limit herein only refers to that specified by the administrative department for patent under the State Council, excluding those with extension specifically banned by the Patent Law or its Implementing Regulations.
